        High court is first day or years later. Also depends on the nature of the case.

          Civil suits are very slow. It generally takes 10-12 years for a partition to be decided and if the lawyer actually wants, he can drag it for 20+ years also

              Also, the summons are just regular procedures, when someone files a case against you,court will ask you to come and explain your stand, for that summons are issued. Hire an advocate, he will handle everything. Keep the original WILL very safe.

                You have the right over the property. He is trying to go for partition by negating the WILL but it will take years for the suit to be decided. Hire a civil lawyer who is an expert in land laws. They can’t take anything from you. File a police complaint if things like harassment continue.

                  Your situation is a bit complex, if you gift it to your daughter,your husband can always get court permission to sell it for her care in case you are not there. Same goes for WILL. I believe you should talk to a lawyer who is an expert in WILL and Trust creation. That should do the job.

                    Fight it out in court. He has a weak case. Say this it was given as surety and later cash was paid. The transaction was done years ago and at that time he said the cheque was lost. Now he is fraudulently coming and harassing. Find an advocate and file a fraud case against him too. Fight it out

                      If it’s being taken by government then the government will give compensation and it usually is way higher than the market rate. That is the reason property dealer is asking to sell. You can sell it but don’t do it at discount. Negotiate. Also, all the other issues will be solved by government only, so not a problem if you can wait for a few years

                        You are right. In that case, find a buyer, take a hit on the total price and be done with it. It’s the easiest way out.

                            She has claimed it, her ability to prove it is very debatable. I have seen students in engineering dying and their parents getting 5 lakh as compensation. Just let them contest. Get legal aid counsel from court.

                                Did the order say ” Dismissed as withdrawn”. Mostly the judges will give the option to withdraw before they dismiss the case. If it’s not that then the above reply is relevant for you.
