And lawyers keep milch . It’s high time they are more transparent in their fees . Not a lawyer but by observation can say : Our country is enshrined as a secular state. There is no provision or mandate to prove your Religious belief to the state. There are no regressive laws which seek a mandatory compliance. Yes in order to bring more equity in the society Religious minorities and marginalized communities do receive incentives . The obvious example is Education and Govt employment under OBC quota others . You won’t be able to get a caste certificate to avail the benefits. Similarly I hear , correct me if I am wrong Muslims get subsidy to do Haj pilgrimage here you may lose the benefits for a foreign travel economically . Another angle you need to check is marriage law and succession law will need proof . Here your wife and children are stakeholders who may or may not align with your belief . March 17, 2025 at 1:23 amYes NOC is needed even more if the buyer is funding through bank loan . Selling car park space separately by the builder in all cash is usual . In case of Mumbai municipal rules car parking space atleast 1 car is an essential amenity which has to be part of flat purchase . And here is the dilemma which the society may face , as in future it will be their responsibility to offer the same . So it’s. confused situation. Right now the only option is you ask the new buyer to give an undertaking that he has no requirement for parking space nor he will insist in future , attach it along with a sale document . I don’t think this will resolve your dilemma immediately but please do engage your neighborhood irrespective of religious or political affiliation and objectively share the hazard of high decibels . In your case The bank had just a symbolic possession and has sold on the ” A is where is , whatever it is ” . This is a norm as much as selling off only those properties that they have physical possession , All this is clearly mentioned in auction documents, Symbolic possession go in deep discount on the property is to compensate for the effort to get physical possession . You have no other option but to follow the norms as the rest all follow it conventionally.
