NAL: If the seller has the clear Title to the property, you have got nothing to worry about the loan. The bank would not handover the property document, unless the loan is paid in full.
You can also visit the registrar’s office to check if there is any hypothecation on the apartment ownership.

Not a Lawyer: But here is what I would do. Since 21 days have passed, will reach out to their channel of escalation (15 days wait period). There would be two outcome possibilities:

        1. They share the foreclosure letter. I would pay the money. Get my documents back and then reach out to their escalation desk again asking for the compensation. If they agree to this, good else I would report them to RBI Ombudsman for malpractice and ask for the compensation along with the interest on the compensation.

        2. If they do not share the foreclosure letter, write to RBI Ombudsman detailing everything and demanding adjustment of interest payment in the overall foreclosure amount.

In any case, do remember that your priority is to pay them and get your documents. Once that is done, the world is your oyster and you can get compensated.

Okay here are my thoughts. The courts you are referring to, do not have time for small time companies. The lawyers you would be dealing with (unless they charge 5 lakhs per hearing) do not understand basics of IT). So to them and a regular court, your friend stole the data (albeit untrue the employer can claim that his actions caused him loss).

            Not A Lawyer:

Use ChatGPT to generate a notice of dues. Send this to the CEO of the company via speedpost (where they get signature of the receipt of your notice from the recipient). Make sure the notice has 15 days response time. Send the same letter on the email. If they guy is not some con artist, he would give in rather take this to the court.
