      65(B) was easier. 63(4) now involves submission of hash code too. There’s a proforma given in the BSA in the form of which submission has to be done.

          I understand what you’re going through. In fact, I am handling a case that is almost identical to yours. My client is a lady who had a brain stroke and suffered paralysis. Her father died prior to marriage. The husband abandoned her, and married another woman. The husband and his second wife have two kids now, while my client lives with paralysis with her widow mother and an unmarried sister. We have filed a FIR, a divorce petition, and a petition for maintenance.

          To you, I’ll be direct – please don’t expect, as became apparent reading your responses to people’s comments on this post seeking retweets, police or government officials to work in your favour just because few people have retweeted your grievance. Even if your grievance attracted thousands of reshares, the hype will die sooner or later and the matter will gain only dust.

          It is not your fault that the machinery will not investigate injustice despite receiving the complaint (through offline or online modes). It is the miserable, unfortunate, and dark reality of Indian justice system.

          Realistically, if you want some remedies against the people who subjected you to cruelty, you will have to spend some money. You’ll need to hire a good lawyer. The only exception to this is if you find a lawyer who takes up your case pro bono (i.e., just for the good cause, without charging you anything). But in any case, a decent lawyer is a must.

          If you are not able to find any, you can approach the Legal Aid Cell of your city. It is a government cell that helps disadvantaged people get access to lawyers free of cost. As it is with all free lunches in the world, the quality is not at all reliable. If I was poor and I was stuck without money needing a lawyer, I would better plead with someone good to take my case for free, or on the promise of delayed payment, rather than hiring the legal aid guys. However, I am speaking this based on my experience in Rajasthan, your city may have better alternatives.

              Straighten up your back.
              You need to file multiple cases. This will involve going after your mother, her brother, and defending yourself from the bank. Connect to a good lawyer for consultation. This can be as dangerous as it gets. The contents of that PoA and any correspondence related to this are also very crucial.
              Don’t choose to ignore this, as the bank will let go of you till they recover every paisa from you of the principal, interest, penalties, and litigation costs, damaging your CIBIL all the way through.

                  A lawyer here. Don’t expect that you would solve this problem by seeking answers here. You are involved in complex litigations that have civil and criminal consequences. I know running away to another town would have given you comfort that you didn’t feel before. But law doesn’t allow that. In the eyes of law, person running away is not a victim, he is a fugitive. So, stop and face the law. Engage a good lawyer to handle your cases. Police cannot evict you from any property. Eviction is a civil matter. Police can exercise their matter only with regards to criminal actions. Straighten up your back for a good, solid, legal battle. And in cases like this, online solutions are often the most suicidal. Engage an advocate.

                    No, you are interpreting it wrong. He has to face both fine and imprisonment. If he fails to pay, he faces additional imprisonment. But that additional imprisonment does not absolve him from paying the fine. So, what remedy do you have if you want to recover the amount? You will have to apply for attachment and sale of his property. The sale proceeds will be adjusted towards his liability to pay.

                    However, practically, it sometimes get difficult to get the attachment done. You will be required to produce a list of property owned by him.

                            A lawyer here. I’ll strongly suggest you to accept one advice – never ask a lawyer whether you should take a divorce. It is your decision. I understand the confusion. I understand that you need to talk and discuss this through. But lawyers, and similarly this sub, are just not the right guys.

                            When you have a hammer in your head, everything appears like a nail – that is the same thing with lawyers.

                            Discuss this with your friends and family, or a counsellor. When you’ve made up your mind that you want to separate, it is then that you approach a lawyer. The question should not be “whether I should get a divorce?” That’s your piece to answer. The only question should be “how to get a divorce?”. That’s the place of lawyers.

                            I hope this doesn’t agitate you. But don’t ruin your marriage because a lawyer inspired you to.

                                A lawyer here. It depends on the terms of employment that you’ve signed with your current employer. If it bars any part or full time work, then it would constitute breach of employment conditions. If the t&c are silent, you are good to go.
