        OP. The following rules apply regards citizenship, which depends the year of birth:

        If born between 26 Jan 1950 โ€“ 1 July 1987 Automatically Indian citizen (even if parents are foreigners).

        Iif born between 1 July 1987 โ€“ 3 Dec 2004 Citizen only if one parent was Indian at time of birth.

        After 3 Dec 2004 , Citizen only if one parent is Indian and the other parent is not an illegal migrant.

        If not eligible for citizenship automatically
        then apply for citizenship by registration under Section 5(1)(c) of the Citizenship Act:

        A person born to Indian parents, residing in India for at least 7 years, can apply for Indian citizenship.

        Apply online through MHA’s Citizenship Portal. “Form III”

                Yes.

                It may be simpler. There are certain jurisdictions, and surprisingly are countries few know about.

                Belize for example has strong asset protection laws, and trust can be setup for 2,-3,000 USD, and annual fee of 1,000 USD. Strong point: Foreign judgments against beneficiary are not recognized.

                Nevis Island and Cook Island (Very Popular) are good for large trust. Also very secure, are good for large high value assets but cost 5,000 USD to set up and anually 5,000 to maintain.

                Dubai, thru DIFC Wills and Trust and Singapore offer similar facilities and cost 2,000 and 3,000 USD to set up and USD 3,000 to maintain.

                Have a friend from UK who is using DIFC for protecting his assets.

                  Make a complaint to the police. Also with RBI and bank’s ombudsman.

                  Doing it in writing is must.

                    Visit the banking person.

                    Submit the complaint with all necessary documents. Take acknowledgement on a copy with bank stamp.

                    Speak to the manager. Tell him you will lodge a police complaint and also with bank’s ombudsman within 24 hours. And do it.

                    Impersonation is either an inside job as banks are very cautious with credit cards.

                        Law is for you if you are a graduate from some top law school or with exceptional abilities are practicing law at High court or Supreme Court or employed by top multinationals.

                            It’s tough situation, but you may have grounds to pursue a refund.

                            Consumer Protection Act, may help. You can file a claim for selling thru
                            Misleading Information or misrepresentation. As the salesperson’s promises and the agreement don’t match you will need to argue that you were given misleading information, which is an unfair trade practice.

                            Undue Influence/Coercion: As your wife signed under pressure and without adequate time to review the agreement points to undue influence. This makes the contract potentially voidable.

                            Unfair Contract Terms: A blanket “non-refundable” clause, especially when not clearly disclosed before payment, can be considered an unfair contract term.

                            Deficiency in Service (Potentially): If the package promised certain amenities or benefits that the company now denies, this could be argued as a deficiency.

                            **Actionable Steps:**

                            Document everything.

                            Write down everything the salesperson promised, even if it was verbal. Include dates, times, and locations of conversations. If you have any emails, brochures, or marketing materials, save them.

                            Keep a copy of the agreement. Highlight the discrepancies between the promises and the actual terms.

                            Save all emails, letters, and records of phone calls (note dates, times, and the person you spoke with) where you requested a refund.

                            Keep records of your dispute with the bank and their response.

                            Online Reviews: Print relevant online reviews that highlight similar problems with the company. This will show a pattern of unfair practices.

                            Send a Formal Legal Notice (Through a Lawyer): This is the most important next step.

                            Clearly state the facts: purchase date, amount paid, misrepresentation, undue influence, and your immediate request for a refund.

                                Bro, NOC from builder to increase FSI has no legal recognition. It’s like builder saying that you can construct a helicopter landing pad on the terrace.

                                If it was legal to construct additional rooms, builder would have done it himself and pocketed the money.

                                Unfortunately you belived all that you have been told without considering legal aspects.

                                Please consult a professional but I think there is little he can help you with.

                                  There are three issues here. Your right as an owner. Society Rules and Municipal Rules.

                                  You are wanting to make structural changes to the building. This may require to get a load bearing assessment report from a structural engineer and approval from municipality.

                                  Then there is question of FSI. Check on this aspect else your structure will be illegal and can be torn down.

                                  Finally without conveyance deed, you are on weak grounds as builder may object.

                                  If you wish to go ahead, ensure compliance with the law else you can get into trouble.
