      the current case of forgery of Passport itself is a severe criminal charge is least of your worries. Get a good lawyer and although it’s a tough road you can get this quashed depending upon what evidence you have.

      But I doubt you can surrender Indian passport easily now.

      What I understand 2 things can take place

      1) the charges can be upgraded under Passport act 1967 for holding dual citizenship which is again severe and involves long jail term and fine.

      2) if you are able to get the forgery case quashed she can be immediately re- arrested for dual citizenship under above act. Because you jsut proved she is holding 2 citizenships knowingly.

      Remember the crime is already committed. You cannot just go and surrender passport now.

      In either of the above 2 cases you are in serious trouble.

      Get solid legal representation. Inform Nepal embassy and get ready a lot of money.

        This is a serious offense and Reddit won’t be a help here.

        Approach a good immigration lawyer in Mumbai who can handle NRI affairs like Prem Kumar Pandey and Associates , Vaibhav Chaudhari and associates or MZM legal .

        Be ready to spend a LOT of money. 1 Lakh is nothing.

        Dual citizenship is serious offense and you can be jailed upto 5 years.

        Don’t think of running away while out on bail. This may very much complicate matters as in India authorities sometime love to pursue trivial matters.

        Hope you sort out the case .

          Personal advice :

          You are in a bit of soup. Courts tend to agree with the employee mostly.

          Below points noted by Honorable Supreme Court in Col B J Akkara Vs Union Of India

          (a) The excess payment was not made on account of any misrepresentation or fraud on the part of the employee.
          (b) Such excess payment was made by the employer by applying a wrong principle for calculating the pay/allowance or on the basis of a particular interpretation of rule/order, which is subsequently found to be erroneous.

          Even if you look at other cases like Sanjay Sharma Vs State of Punjab and others , Sahib Ram Vs State of Haryana

          Etc all these cases point out that courts are lenient and will side towards employee if employee has not done fraudulently .

          If your employee is willing to pay it in installments so be it . You can take it. If you force this and employee gets a representation then the money gets stuck.

          You cannot start recovery proceedings in this case.

          Best case negotiate without forcing signatures .

          Rest you can always get a lawyer who can guide you in detail.

            You didn’t specify what kind of loan it was . While taking 5 lakhs loan did you keep your house papers as guarantee ? In case if you did then unfortunately nothing can be done other than requesting the bank to give you sometime .

            If the house papers are not kept as collateral then the banks can’t do anything .

            Still best to consult a lawyer

              Let me be the devils advocate and tell you about my experience. Once upon a time I was engaged. Arrange marriage. I wasn’t pressured into marriage but again i wasn’t actually too willing. By that time i was living in Singapore for a significant amount of time.
              Over the course of next few months post engagement and before marriage we used to talk often. Over the period of time we both realized that the match is not good. We were incompatible. The arguments, different expectations and so on.
              While neither of us were willing to tell our parents because of the grief it will cause them and we’re trying to force each other to inform. Time was passing.

              I got lucky because one day her father got too drunk and did something which automatically led to wedding cancellation.

              I understand where you coming from. A lot of comments here are blaming the boy. Maybe he is at fault. I don’t know. Our society is made up of people who never think rationally but love to blame the easiest person.

              I would say do two things

              1) speak to your sister and console her in case if she is distressed.

              2) get a letter drafted from any lawyer for your expenses and attach the proofs if you have. Send the demand letter.

              3) if you really want to push it demand an apology from the family as well.

              However, what will it get you ?

              The grief will go with time. Your sister, bless her heart, has also to move ahead.

              Take this as a lesson. Revenge may backfire in useless court cases. But again I am not a lawyer.

                  The first step is to take legal advice. Google and Reddit won’t help much and will confuse you. Take the situation in your hand. Either download legal kart app and get legal advice there after paying or go to the competent lawyer handling financial matters. Only he can offer you a proper advice.
                  Having said all that, nothing is gonna happen. You haven’t hacked the system .
