January 20, 2025 at 11:14 amYes, a munshi is a clerk employed by an advocate, mostly at junior or lower court levels, as their practice is not big enough to accommodate dedicated reception or paralegal staff. The munshi facilitates all those roles and is often seen as a driver and fixer.Ideally, you should be paying them something to the effect of โน200-500, as they make your work much more efficient and faster by helping the advocate.
In many cases, advocates take something extra in the name of the munshi. Whether they give them a cut or not is debatable.January 20, 2025 at 10:05 am in reply to: Need Urgent Help: A Guy Took My Money and Blocked Me #70756IIndianshivansh3984

January 20, 2025 at 10:05 amGenerally, standard charges are:1. Legal notice ~โน2-3K.
2. Per hearing, an advocate may charge ~โน4-5K + a/l 500 for munshi. Now, how many hearings are required to conclude the proceeding depends on the facts of the case.
Additionally,
The court may or may not allow the full cost of legal proceedings, as then it can become a hostile tool to harass people.
I can just employ the best, but unnecessary, advocate for the smallest offence and bankrupt the opposite party by the legal cost alone, so despite what the advocate might say, “legal cost recuperation” works within reason only.January 20, 2025 at 9:52 am in reply to: Need Urgent Help: A Guy Took My Money and Blocked Me #70743IIndianshivansh3984

January 20, 2025 at 9:52 am25K is not a substantial enough amount for which legal action is viable.
But legal theatrics, like sending a legal notice to his home, could help you get your money back.Filing a civil suit to get just 25K is not a smart thing; the lawyer’s fee alone would be higher than that, not to mention the associated headaches.
Sure, you can add the legal cost to your suit as well and add mental torture (which rarely works). But initially, you would need to pay it yourself, and if/when you win, you might get an order to get the same from him, but then again, executing an order for such a small amount is a headache and requires legal fees again.

January 19, 2025 at 1:05 pmYou cannot cancel the loans.
Ideally, you should pay them off in full so that you maintain a healthy credit score for future credit facilities, as you never know when you need to borrow money.
But in the case where you cannot pay them, you can opt for settlement options. This would, however, mean that your credit score would take damage and your credit history will show that you have settled a loan.January 19, 2025 at 11:23 am in reply to: [urgent] can I get in trouble for abusing my ex gf on insta after she provoked me #71221IIndianshivansh3984

January 19, 2025 at 11:23 amYes, of course. She can only frame you for abusing her, but also for stalking her and threatening her.
So, it is always wise to be mindful of what you say to a woman. You are 16, and this is petty, so unless she is really persistent, the police may not do much except maybe call you to “teach you a lesson.”

January 17, 2025 at 6:10 amBanks do not have the authority to arrest anyone. Even if your uncle has done something criminal in nature, the banks would need to follow due process and then have the police arrest him (or you).Next time something like this happens, threaten to call or actually call the police.

January 16, 2025 at 10:24 amPeople often get confused between ancestral and inherited property, so first, make sure you are not.Seeing that your grandfather has the title, it can be assumed that the house was his to bequeath to anyone of his choosing, which he did.
Here, in your case, S30 HSA would apply, and you (along with your other daughter and your mother) would inherit the house.
The aunts would not have any claim.IIndianshivansh3984

January 13, 2025 at 12:49 pmDo you have any sort of official confirmation that an offer to settle was made/executed?
It does not take 45 days to share the settlement letter, oftentimes, they share that with you immediately.January 13, 2025 at 8:56 am in reply to: Are my retired parents entitled to my unemployed sister’s money? #75440IIndianshivansh3984

January 13, 2025 at 8:56 amu/ S4 Senior Citizens Act and S144 BNSS, children have an obligation towards their parents to maintain them. But this does not mean that the parent can extort their children in any manner. The main caveat is that the parent must not be able to maintain themselves with their own income. Here, as you have mentioned, the father and mother have pensions and rental income, so they could be said to have the means to maintain themselves.
Even if they did not, the maintenance covers only the basics and does not cover anything frivolous.IIndianshivansh3984

January 13, 2025 at 8:47 amIn many cases, it has been observed that TPAs make false claims just to make the defaulter pay some/any amount, as they get paid based on the amount they are able to recover.
This is why it is important to have everything properly documented. If you have settled the loan a/c and C.C. debt as mutually understood between the bank liaison, your case should have been closed and updated everywhere, and you should have received a closure letter.Do note that sometimes it can take a while before it is updated everywhere, which can result in overlap and TPA contact.
For this, the liaison officer should help ensure that you are not unduly harassed. If you think there are some discrepancies, you can first complain to the bank’s grievance department and later to the banking ombudsman.

January 13, 2025 at 8:34 amIt might not seem fair, but all that you did in service of your parents does not count unless it was factored into the will by your father. As it was not, your brother is legally owed his share, which would be 1/3rd of your father’s now intestate estate. The best you can do is to get the estate divided among all surviving heirs and then ask your mother to make a proper will in your favour.
This would both give your brother his share and provide your 66:33 shareJanuary 12, 2025 at 8:02 am in reply to: Can a person with ongoing divorce court case have GF / BF? #76378IIndianshivansh3984

It could easily backfire on you, especially if you are a man; for women, it is generally a slap on the wrist.January 11, 2025 at 6:56 am in reply to: Please please help me. Getting scammed by a loan app! #76583IIndianshivansh3984

January 11, 2025 at 6:56 amThese are scamsters masquerading themselves as payday loans (which themselves are borderline unlawful).Their whole modus operandi is to create debt obligations and, side by side, get access to devices and persons.
They have your details; they will contact you.
The only way to get out of it is to make it not worth their effort, to make it harder to blackmail you with material and avenues.

January 11, 2025 at 6:48 am1. Check CIBIL to see if a new loan account has become active.
2. Keep the funds as it is, there might be a minute possibility that you may get out of it with little extra and foreclosure.
3. It does not take that much time to copy contacts, but gallery as it is large, might be safe to some extent(Not 100% can be copied in the small amount of time).
5. Make your socials private, including your WhatsApp profile picture/name to “only contacts”.
6. If/when they do contact, do not give in to extortion at all.
7. keep a log of numbers, record initial(all) calls and file a cyber crimes complaint. -
