      People majorly interact with the law when things go wrong—nobody likes to deal with the police or courts when everything is fine.
      A cursory look at the criminal legal sphere might make you believe that no relationship or friendship is safe, let alone marriage. There are enough cases of fathers raping their daughters, or daughters killing their fathers over something trivial, and many other such disturbing scenarios.

      It would be wise to learn from these things reasonably, but not let them overwhelm or radicalise you.

        The photo of a cheque was not a wise thing to share; you should have shared your details in a better way. But even that might still not be enough for him he would need more to create a legitimate loan obligation.

        Keep your chats handy. It’s always better to have an overwhelming defence than to depend on the accuser’s side being insufficient.

          1. Keep backups of your chats and any other evidence that might help establish your side of the story.

          2. Just because he has transferred you the amount via bank transfer does not entirely prove that he loaned you the money. It is now a case of your word versus his, and as he is the accuser, the onus is on him to prove that it was a loan.

          3. Where is his evidence to support the claim that this was a “loan with an understanding of repayment”?
          Is there any promissory note or chat/call evidence where you asked him for the money?

            It is not so simple; to cite self-defence, you must show:

            1. Imminent danger.
            2. Continuous and/or escalating danger where, unless force was applied to deter or stop it, the situation would likely result in death/grave injury/rape/kidnapping.

            Also, the force used needs to be proportionate to the threat present and must not be applied in pursuit of revenge.

            Following these principles:
            1. Pepper spraying someone merely for staring at you would be deemed excessive force, and the girl could face charges.
            2. Using pepper spray in response to being groped would be considered reasonable and proportionate.
            3. Although groping is a serious offence, it may not cross the threshold required to justify potentially lethal force, and the girl might face serious criminal charges.

              Prenuptial agreements are not valid in India. Any such agreements made will be overruled by the applicable law of the land, and they would be held invalid.

              Even the Goan prenups are not ironclad, and it is a headache to implement them within the state; good luck even trying to do so outside of Goa.

                The bad news is that, from Simpl’s perspective, these purchases have been made by you, and you owe them money. It is not their concern if you are unable to keep your account secure from such unauthorised access.
                They are well within their rights to initiate relevant recovery proceedings against you.

                The good news is that, for most users, Simpl does not report to CIBIL.
                Although in January 2024, they did attempt to implement limited eKYC and CRIF/CIBIL score requirements, this was not followed through for all users.
                I would advise you to check your CIBIL report to see if it reflects any such reporting.

                  Ask a DRA agent for their ID and DRA number. As per the RBI guidelines of August 2023, all DRAs employed in any capacity for money recovery must be DRA-qualified.

                  They are not allowed to shout, abuse, or threaten the defaulter in any way. Their job is simply to inform the person that there is a pending due. It is not within their purview to “recover” the money by force, whether verbal or physical.

                    2. Unless the parents have expressly willed the land in your favour or transferred it to you during their lifetime, in the absence of a will, intestacy laws apply. Your sister is entitled to her equal share in the inheritance, regardless of what she received during her wedding.

                      It is rare and surprising for a bank to be able to bring such trumped-up criminal charges. The same are often threatened in most notices received by people in default cases, but even banks know that most courts do not entertain them in that manner.

                      It would not be difficult to defend, provided your situation is as you say and as long as they are not able to prove wilful default on your part

                        A loan recovery agent cannot, by force or threat, repossess the bike; there is a due process to be followed.
                        The bank would not take such action; it is not in their best interest, especially when it has only been 90 days since default.

                        This is likely a TPA trying to scare you into paying. A 20 day default is considered a minor one, and there’s nothing much to be worried about.

                            1. Fake lottery/gambling and claiming wins.
                            2. Fake interpersonal loans, along with interest and penal interest.
                            3. Fake consulting companies rendering fake services and billing extremely high.
                            4. Buying property for cash, which then sees a surprise (fake) boom in price due to some reason.
                            5. Buying art that suddenly (fakely) gains fame and becomes 100x more expensive.

                              1. Be in communication with her or her family, and keep things as gentle and polite as possible (and keep evidence of this as well).

                              2. If feasible and her family supports it, you could consider marriage counselling.

                              3.If the wife is amicable to a mutual divorce, make sure that your interests are taken care of. Although legally, she is entitled to a lot, and under threats, many women get away with much but when done practically, it is not uncommon for wedding gifts to be returned.

                              4. But do not make this about ego or justice; it is about cutting your losses and quitting while you are ahead.

                                That would not be wise.
                                Your issue is with Reliance Digital, not with Bajaj Finserv. You would only be damaging your CIBIL and future credit potential if you do so, not to mention the TPA harassment Bajaj is known for.
