1. Public space ≠ Free-for-allJust because someone is in a public space does not mean their body is public property. The law distinguishes between general public recordings (like filming a concert, rally, or tourist spot) and intrusive, sexually motivated or non-consensual recordings.

2. Sections from the IPC that apply:
IPC Section 354C (Voyeurism):
> “Whoever watches, or captures the image of a woman engaging in a private act, in circumstances where she would usually have the expectation of not being observed…”
This includes acts done without consent, even in public if the focus is on intimate parts (breasts, buttocks, thighs, etc.).
IPC Section 509:
> “Words, gestures or acts intended to insult the modesty of a woman.”
Secretly clicking photos with sexual intent can fall under this.
IT Act Section 66E (Violation of privacy):
> Capturing, publishing or transmitting the image of a private area of any person without their consent, under circumstances violating their privacy.
“Private area” is interpreted contextually — and a bikini-clad woman at a beach doesn’t give automatic permission to record her chest or butt.

When Is It Illegal?
Recording is illegal in public if:
The subject is a woman and the focus is on her breasts, buttocks, thighs, feet etc. with a sexual undertone.
The image/video is taken without consent and later shared/published, especially online.
The person objects, and the recorder continues.
It causes mental distress, embarrassment, or violation of dignity.
The person is being targeted, followed, or stalked.
There’s an intent to sexualize (even subtly) or dehumanize.

“But I was filming the building…”
This is a classic excuse, but intent and context matter. If someone zooms in on a woman’s chest or butt while pretending to record a building or sunset, and especially if that footage is later used/shared sexually — it’s clearly harassment and potentially criminal.

So where’s the line?
Consent + Intent + Context are key.
Filming public events or people as part of a crowd is usually fine.
Targeting someone’s body, especially private parts, even in public, without consent, is a violation.
Sharing such content online further worsens the offense.
