On the contrary, malicious and defamatory accusations are being made by the residents.I am sure the residents/police are batting to invoke BNS 291, but there is no demonstrable danger to human life or grievous hurt (since no prior evidence of the dog’s escaping/attacking/aggression exists) so the section will fall flat in Court.

At the top of your package, you have to mention in bold letters INSURED SPEED POST, INSURANCE VALUE Rs. XXX.Some post office workers are not familiar with it. You can speak to the post master of the branch and get it done. Insurance can be done for every post and every parcel, do not let them fool you into believing otherwise. It’s just laziness on their part.

April 4, 2025 at 3:53 amLawyer here.India does not have the concept of punitive or exemplary compensation. So your best bet is to take what they’re offering. Just because you’re claiming the value of the shipment is 4k does not mean they are bound to pay it. The shipping document/contract/receipt they give you always states the maximum amount of their liability. Even stuff sent by India Post, the government service, has their maximum liability capped at 2x the shipping fee paid.
In future, for high value shipments, you are recommended to use India Post’s Speed Post with Insurance. There, you are paid back the full declared value in case of loss/damage in transit.
