      Registration is mandatory only for agreements having a duration of more than 11 months.

      But it’s not like we can’t register the document if the duration is lower.

      The main difference between LLAs and rent agreement is the nature of the property after the agreement is done. LLAs give you a license to use/occupy the premises. But no right is created.

      In rent agreements a temporary right is created to use the premises.

      All malls in India use LLAs when dealing with various companies who want to open their stalls in the mall.

        You’re only waiving off your right to initiate civil proceedings in the event this particular situation arises. This is legal. The party will still be able to sue because of any other dispute.

        Settlement deeds usually contain such a clause as well. They usually contain something along the lines of “party A hereby confirms that the dispute is resolved to his satisfaction and affirms that he shall not initiate any legal proceedings against part B with respect to the subject matter in the future.”

        Also, the most important part of any property transaction is possession. You can use this clause as a justification to throw them out and regain possession. Even if they do initiate proceedings, you can easily quash them. And if you can’t, at least the possession of the property will be with you. You’ll have to maintain the status quo during the course of the court case, but at least it’s safe with you.

          Leave and license agreements. That’s what is mostly used by people renting an apartment. It’s different from a lease.

            Hi OP. This will take time.

            Just a thought for next time. Next time if you rent out your place to someone, insert a clause stating that if the tenant doesn’t hand over the vacant occupation of the premises to you at the time of expiry of termination, you’ll be entitled to block their entry and throw away or dispose of their articles as you wish, and that this would not render yourself liable for any civil or criminal action. Add further things which support this and make this non negotiable clause.

            And register your LLAs from now on so that your rights are air tight and cannot be disputed in court.

            What’s already done is done. This is just something to be followed from now on.

              Go to the head office and speak with them in person. Send a registered notice to the nodal officer. They will have no choice but to reply to it and tell you why your account was frozen. Ask them if it was frozen due to an order from any authority. If it was, speak to that authority and tell them you’ll comply with the investigation procedure.

              Also let the bank know that regardless of the freeze, you expect interest amount to accrue on the FD.

              If there is still no resolution, then hire a lawyer and file a writ, and write to the RBI ombudsman.

                Legal notice through registered post. Hire a lawyer to draft one.

                Consumer cases won’t cost a lot. The majority of the expense will be the lawyer fees, if you plan to hire one. You can file one by yourself as well. It’ll be a bit hectic.

                  File an FIR of theft against the son. It’ll be sufficient to protect you against any consequences from the law.

                      Pressure them to file FIR. Police are hesitant to file FIRs because it’s more work for them. Ask them for the copy. If they’re still not doing it, approach any legal aid clinic and ask them to accompany you to file an FIR.

                        Them filing a case against you will be akin to them shooting themselves in their own foot. They won’t do anything. I hope you have some sort of proof for your claims.

                          If the police are refusing to register an FIR, then hire a lawyer and approach the magistrate and file an application to register the FIR. The court will go through your complaint and will direct the police to do so. Make sure you have all the evidence ready.

                                Answer you are looking for – Yes.

                                Advice most people here will give you (including me) – talk to the dean/principal. Let them know about things. Spread the word. Gather support. Let everyone know what is happening. If you have a student union, talk to them and have them interfere. Educational institutions care about their reputation. Without it, they’re nothing.

                                If possible, try to solve things before sending a legal notice.

                                  Take the L and learn from your mistakes. You guys are not even majors and triple riding? I’d assume none of you wore helmets either. Risk for yourself and other commuters on the road.
