        It is a HUGE MISTAKE to let the same tenant live uninterrupted for such a long time. And I imagine without a contract.

        Check out the laws on “Adverse Possession”

        Right to property in India is not absolute. Indian judicial system is horrible and everything takes a lot of time. Laws are extremely tenant friendly. Owing to the history of zamindar/landlord etc making people homeless (something like that)

        Your tenant has gone to court – so now the matter is in court.

        Do not threaten the tenant or do anything extra-legal
        Find a good lawyer and follow the proceedings. Its not enough to argue – this is my property and I want it back. Your parents need to argue that it is their source of livelihood and they will starve to death without it etc. etc…

            I know for a fact that there is a process for expedited trial.
            You can file a petition in High Court requesting expedited trial and then the high court will pass a order directing the lower court for this. Not sure under what grounds, this is considered.

            Please talk to you lawyer about this.

            What this means is that the court dates will be less far apart and perhaps the lower court will hasten things up a bit.
            Best to not get your hopes up too high. It is likely to still take years.

            Best piece of advice i can give:
            You HAVE to start living your life in parallel.
            You cannot put your life on hold waiting for the conclusion of this case.
            You have to treat it like you would a disease like diabetes and let it go on in parallel.

              In my perception, I think, the chances of getting beaten up in North India (for anyone) is much higher than the chances of getting beaten up in South India (for anyone).

                What exactly would it cost you ? Considering that you mention that the damage was minor, it would undoubtedly cost you way more in legal fees, hassles and mental stress than repairing it.
                The fact that they are willing to pay you 2000 ruppees is I would consider a good gesture already. Don’t forget your hitting the driver would likely be a crime of assault.

                  Correct. no one can stop you from filing for divorce.
                  Getting it is a different matter altogether.

                    NAL. Do you have a divorce case ongoing or had discussed such with your wife. Any conflict or discussion of divorce, that would have happened? All such evidences need to be preserved. Filing this kind of cases is now Standard Operating Procedure – and is usually accompanied by Divorce proceedings from either side or a precursor.

                    This has become a cottage industry and it is a pressure tactic to extort more money from you.

                    There is unfortunately no easy way out. Find a good and trusted lawyer from close references and follow what they say. First step is Anticipatory Bail obviously. But after that please be mentally prepared to spend possibly years to run around the legal system.

                    In theory – yes, HC can squash fake case. But it is not straight forward and can be contested etc. Either way it will take months if not years, so stay strong and be mentally prepared. Can really not do much till your wife’s energy runs out and/or is satisfied by what you can offer (almost never the case).

                    For some reason the burden of proof has shifted. It is difficult to prove that something did not happen. Next to impossible to prove that something did not happen.

                      Something to clear up.

                      NRI = Non Resident Indian. that is Indian passport holders who are NOT residing in India. This is not the case for your child.

                      Your Child is Not an Indian Citizen. OCI , overseas citizen of India.
                      Treatment is more similar to a Foreign National albeit of Indian origin.

                      You will be able to get nothing done in courts. If you cannot change his nationality moving back to his country of nationality would be the best bet.
