      It seems they have started the investigation. Considering he is your immediate neighbour and that you have complained about it, your statement becomes important. What Police is doing is standard procedure.Police is in evidence gathering stage, you are an important part of their evidence. There is no reason for you to be panic. But it would be wise to take a lawyer with you for your own peace of mind. If you have CCTV and are not afraid, give it to cops. Cause neighbour will know who complained eventually.

      You can refuse to give statement as well fearing for your own safety. That is an option.

        Sorry for your loss.

        As someone already said, you ll need to gather all evidence first. Once you have that you will need to decide if you want to proceed under civil law or criminal or both. It will be better to take opinion of other doctors as to what wrong was done by the other doctor. This would be difficult to get though.Even though you are a doctor, you will need more people to say what you are saying, as court may not consider you a good witness on this subject as you are related to the deceased.

        Under criminal law, you will file an FIR and if all is proven (which may take many many years) then there will be an imprisonment or fine depending on which section sticks. There would be appeals etc which will delay this further.

        Under civil law, you can file a complaint with the medical council or file a suit for medical negligence and damages/compensation, which will again take many many years. You will have to send a legal notice in a civil claim prior to initiating proceedings.

        Please be aware, in India judicial process is a punishment itself for the litigant. Also, the evidence and proof to prove negligence will have to be very very good, the threshold is quiet high in such cases.

              There is no “quickest” legal way to this unfortunately.

              I am assuming you have a registered leave and license with this guy. If yes, send him a legal notice for eviction and termination of leave and license. Most of the times a person folds after receiving a legal notice.If he doesn’t, file a case before Small Causes Court, as it’s a registered leave and license, the proceedings are fairly simple and quick.

              Legal proceedings in cases where there is no registered leave and license are long drawn and may take years. Yours should not be the case. So stop wasting time and send the notice and file the suit for eviction.

              If you cut the electricity or water, it’s a criminal offence, so don’t do it.

                  Yes. Notice and consumer case. You can claim 1 lakh for mental harrasment and legal expenses apart from the money they owe you.

                    Firstly, it’s a car rental service – they would have the right to terminate for any reasons, please check terms and conditions properly, no just on your invoice but anywhere on the site. Even if it’s not there, they inherently would have the right to terminate for good cause. In this case, there was a mistake by the algorithm.

                    If they have called upon you to return, one option would be to tell them that you are traveling and use it for a week or so unless they can track it by GPS you should be safe. This will help you recovering your 3k, as they will never refund it.

                    If they are threatening with filing FIR, you first go on and file an FIR/complaint against them under section 211 of IPC, don’t know if it’s there in the new BNS, it should be there though.

                    If they file an FIR against you, you will unnecessarily have to spend time and money defending yourself. And believe me, it will be way more than 3k that you are stuck on.

                    If you want to avoid all these things, just return the vehicle and sue them in a consumer court. You will have to send a legal notice first asking for compensation.

                      Inform your uncle and his lawyer. Uncle may need to substitute the FD document with some other security else he will be put in jail. This is serious.

                        There are many cases like this where the notification by government declaring private land as forest etc. are being challenged and heard by the Collector. You will have to get in touch with a lawyer who practices in these types of matters to ensure that you are well represented. Just an FYI, not every one does these matters.

                            File a non-cognizable complaint with the police giving all the facts and that she is threatening suicide. Involving a lawyer in this process will be helpful. Do this if you don’t want any trouble in the future. This is the legal way.

                                You will have to respond to this notice refuting his claims. You need to get a lawyer having knowledge of IP law to respond to this. Good luck.
