A police complaint will be helpful but if she is scared and cannot leave immediately, I really hope she finds the courage to take a coercive step against him. There might be multiple ways to protect the little girl but if she has to live with him, she will have to find some grit to fight back as the abusive father may try to seek revenge in multiple ways. He may pull back on supporting her financially. Not saying she should take the abuse at any cost. The father deserves the worst punishment. She can surely file a police complaint against the father and also a domestic violence complaint against him as she falls within the ambit of ‘aggrieved person’ under the Act.DDesiknight9081

The maintenance sought/granted (lumpsum or monthly) is directly related to certain factors, the income of both parties being the first and foremost. However, consensually, there is no limit to give/take. Is your husband financially sound enough to grant a lumpsum amount? What are your basic expenses that have to be met to lead a respectable lifestyle, also in consonance with what you were leading when you were not in separation? What are the liabilities and dependence both sides? If you go for mutual divorce, the terms of settlement clearly state that all the disputes and differences between the parties have been fully and finally settled. It also states that nothing shall be now due from either party to the other on any account and that neither party shall file against the other, or against their family, any case or complaint in relation to events arising out of their matrimonial life. So the mutual divorce is subject to that understanding. You’ll find another Advocate doing the same job for lesser, which in no manner makes anyone better or worse.
