        Based on the recent SC judgement where wife was given maintenence from 2nd husband but want formally divorced from the 1st husband where SC said “maintenance is the legal and moral duty of the husband” one can think they are in a way giving legal recognition to such marriages.

        But better to go with divorce first

                You can either drag the matter for years in court or settle with mutual divorce. Post this you can file for defamation against the family for that smear campaign they did. Or you can do it right away and strengthen your negotiating power.

                The only reason they are backing off is that you guys didn’t live under the same roof, otherwise they would had filed all the other cases and you’d be left helpless then.

                  Likely this. But maybe they should send the lawyer alone first so that they don’t face any risk of arrest.

                  Also you said police would had arrested them already if they believed her. But i have heard police don’t make immediate arrests anymore.

                  Also, OP, if the charges are false, vague allegations. You can get your name removed directly convincing the investigating officer that you all don’t even live same city to have done anything. If they don’t listen, you go to court to get the FIR quashed based on the same grounds.

                  Also your chacha can use this to show the courts (in his cases) that the wife is making false cases to put legal pressure on him and his family.

                  After this FIR gets resolved. File case against this woman for this false case and defamation. This should be done because firstly she deserves it, it is your right to get justice not just saving your ass from someone’s false case. And this will also help your chacha to create counter pressure on her to come to a negotiation that favors him.

                    You should get proper documentation that she won’t file any cases on you. Many a times the wife takes some part of the money and then backs out of the mediation. And those mediation document should have the seal of approval of the mediation authority only then it will be legally binding and valid. Otherwise not.

                    Also why is there 2.5lakh difference? Either you are not telling something or they are planning something fishy. Get a good lawyer.

                      They ran away? So they are not in the uncle’s house anymore right? If yes. Under no circumstances you should let her enter. They are likely gonna file false cases if not done already (not clear from your post) and may bring police to get residence in the house and kick you all out later. Note that police cannot enforce you all to have her in. Only a court order can. Nothing else.

                      Consult a lawyer immediately and start making your legal moves. Don’t wait for her to make the first move. That false rumor thing about siblings, file defamation case. If you have proof of the torture (i assume you don’t, and no harm in trying even if you don’t) file abetment of suicide case.

                      Any false cases filed against the uncle and family, can be quashed directly if the allegations are vague and involve every random member of the family.

                        Theoretically yes. You can go to the SC with your plea. Whether they will entertain it or not is anyone’s guess.

                          A broad plea like that will likely be rejected. Especially if you take into account how often SC rejects pleas that maybe difficult to take a stand on, like marriage for lgbtq community, gender neutrality in laws of rape, dv etc. And just say “it depends on the legislature”

                          You could however target something as specific and absurd as the GST system. Cite all the weird ways things are taxed. Like the recent popcorn thing, cars vs helicopter example, roti vs paratha example and many more. But most likely that too will be rejected outright.

                            How did you conclude the practically experienced one will say to avoid the police? Shouldn’t the one who follows textbook approach cite the recent judgement of SC and tell their client to not contact the police without getting a notice?

                              Bruh 3 years is not that big of an age gap to call someone p3do or groomer. Yeah sure when it all started it was illegal. But what’s your problem if they wanna be together? If she wants to get away from.him she will. Clearly you haven’t moved on from her.

                                  Check up on gst rules and if you’re sure about it then file a complaint. There are many people that use gst as an excuse to get more money from ignorant customers
