      Partition suit in your case is one of the solutions. Alternately i will suggest you visit your local District or High Court Mediation Centre. There you can apply for a nuetral mediator to be appointed, preferably a retired district judge, and he may be able to bring the family to an understanding and a settlement deed can be drawn up. All of you need to have a positive mindset to be able to arrive at a settlement or get ready to fight a long battle in court which will result in more bitterness. Mediation may result in repairing damaged ties also. Try doing this..if it works you can thank me later.

        You can still try. Request the court to close it and facilitate closure with sime litigation cost slso added to final figure alongside savings or FD interest

          When i was in a bank, we had a situatikn wherein our customer lost โ‚น16lacs due to debit card being skimmed. We paid out the money lost plus savings bank interest and legal expenses as part of settlement in court.

            That does not make sense. Criminal part is considered a crime against society..that is why the prosecution fights on your behalf. If you want money now and bank is willing to compensate you for lossand say pay you some interest also then no point .ask them to reimburse your legal coat also of need be . Consumer Court will take nearly 1.5 years to dispose off your complaint.

                          Only a local lawyer can do it. They will be able to extract the full records. Ask for fees paid for inspection, certified copy of sub Registrar records along with his final report showing nil encumbrance. Go for lawyer on panel of the bank from where you are taking loan

                            Correct.. in the eyes of law he very much continues to be a director of the company..cessation of directorship, sale of shares to founder or incoming director and finally resignation by filing relevant form with ROC will only record the factum of his exit

                                Ideally they should be doing it as part of their due diligence..check with them..if not get a TSR done for your personal satisfaction.

                                  Hi Lawyer here. If it is already built and used and you are buying it as a second hand buyer, then check out the document trail at Sub-registrar’s office. Use a lawyer to give you a title search report alongwith CERSAI check which will tell you whether the property is free of mortgage to any lender. Dont skimp on this title search and regret later
