      The guy needs to pay back what is not his..period..it is theft by another name..not returning what is not his. A legal notice and filing a civil recovery suit will be best recourse. .The legal notice can also mention that any feedback to new employers in future will not be positive till such time he returns the full money plus feedback to his current employer about his doubtful integrity..his story about father being in debt can not and should not be taken at face value. Agreement and PDC ..your friend is being extra nice.!

        Your friend has to repay the company..period. what is not his ..amounts to theft..by keeping quiet his integrity has come under cloud..a person of good values would have notified the company and returned this windfall ..his ex employer is being nice to him..if he tries to act smart they may even go to police !

                Flat ownership will devolve on all three in 1/3rd share each. Your uncle cannot do any thing as per his will. This is the law of the land and the court will award 1/3rd share to each of them

                  If your earnings are not impacted, you should not stop the loan, the contract with the bank is separate. If possible pls revive the EMIs and regularise the loan, I can understand your frustration, but either you have to go to RERA or to Consumer Court. Make both the builder and the bank a party to this case.

                    Oh ok – now i remember. RBI had banned Banks from facilitating transactions for Bit coins/crypto in April 2018 but it was lifted subsequently vide SC judgement in Internet and Mobile Association of India Vs Reserve Bank of India in Writ Petition (Civil) No.373 of 2018 dated 04-Mar-2020. So if any bank places any lien then this judgment will come to your rescue

                        Thanks for the feedback. The para before AI part, I wrote from my experience as a lawyer and handling 3 cases alone this month (all pro-bono). Feel free to modify the AI text and paste in reply.

                        Problem is there is enough action in the stock market to make legit income than get into trouble on the crypto market by doing P2P transcations and getting whiplashed by parents and family and then the police who will not understand how these crypto txns occur and how to trace the scammers and give relief to the complainant. .. and the case/ FIR if filed will drag on and frustrate.

                        So my objective was only to caution.

                        Do fill in on how to avoid pitfalls !!

                          You have survived one year, you will survive more, so first dump your fear.

                          If the material has been uploaded anywhere, then search for ways to complain and block them from public display. If the platforms cooperate – well and good, else report to Cyber crime helpline or ask a local lawyer to file a complaint against the platform in the Police Station.

                              You need to know which part of the property was mortgaged to the Bank. Bank is entitled to its security and you can only prolong the litigation not win it. Since your uncle us broke, the only thkng you can do is to buy the property either cash down or ask the bank to give you a loan when auction process is completed.

                                  Hi..Either it had been acquired by notification in the gazette or public through newspapers ads. I will suggest you first file a RTI query and ask all the queries and copies of decisions basis which the land was transferred. Prepare to pay the cost of photocopying the full document trail . Once you receive this reply consult a lawyer to file a writ in Madras HC if you want to.
