        Ordinarily, it doesn’t make much sense to file a case against an Employee for such a small amount. All the more, after a period of about 3 Years. Your friend may like to contact the Company to ask them what the matter is.

        It is also prudent to Reply to the Legal Notice as it makes sense to not leave a written allegation unattended.

          These are the possible options. You may or may not get what you want, despite waiting. But that’s all you got. Also, all of them will take time money and energy. So choose accordingly.

              – Raise an Amazon Ticket (you have already done this). Await its response. Seek details of Amazon Agent (Name, Contact Details, Residence) stating you require this for investigation purposes.

              – In the meanwhile, send in a Written Complaint to the RWA/Society Management Committee reciting the facts and circumstances. Seek details of both Guards (Name, Contact Details, Residence). Request the RWA/Society Management Committee to undertaken an inquiry and take action against the Guards.

              – Immediately, get hold of the Local Drive on which CCTV may be saved. Brook no delay as the same may get deleted soon.

                1. Is it a Permanent Job or a Contractual one?

                2. What is the procedure to Resign? How has that been complied with?

                3. What is the Reason for putting Acceptance of Resignation on hold? Is there a written Communication in this regard?

                  – You could write a strongly-worded Letter/Email conveying them your unequivocal desire seeking refund of money, including stating their default (delays, faults, defects, etc.).

                  – Failing which, a Consumer Grievance (in National Consumer Helpline) can be filed;

                  – Failing which, you could send in a Legal Notice;

                  – Failing which, a Consumer Complaint (in Consumer Court) can be filed;

                  There may be available other remedies, depending on the facts and circumstances of the case.

                    That’s a Breach of Contract. You could do the following:

                    1. Send them an Email stating: unequivocal desire to join work; asking for formalities; joining date;

                    2. Failing which, a Legal Notice can be sent;

                    3. Failing which, a Civil Suit for Breach of Contract claiming lost pay, etc. can be filed.

                          If he goes to court, he will be required to prove that the damage was caused by you. I don’t think it’ll be worth the effort, given the security deposit amount must not be much.

                              1. Has he acknowledged handing over of keys? What else was the response?

                              2. Why do you want to avoid talking about Security Deposit?

                              3. Civil Suit/FIR may show up in Background Verification. But I won’t be too worried about it. Simply by having a case against a person does not imply that person is guilty.

                                You could send in a message as follows: clearly stating keys handed over on so and so date; all rents duly paid; requesting for security deposit.

                                  It would make sense to have the following as well: “unconditionally settled”, “no grievance, claim and action against the Accused”, “full and final settlement”, etc.
