      It needs four generations.

      Ancestral property refers to property that is inherited from previous generations without division of shares over a long period of time. As perย Hindu law, for a property to qualify as ancestral:

      It must have remained undivided for four generations from the paternal side. This would cover the ownerโ€™s father, grandfather, great-grandfather and great-great grandfather.

      The heirs in the succeeding four generations must have inherited this property by birth without any division or partition of shares.

              Much though I would like to comment on non legal matters connected with the post, I won’t.

              Whatever you are proposing has no legal relevance and in fact will put you on weaker ground in any legal proceedings in the future.

                The onus of TDS is on the deductor. No court or government department will recognise any agreement to the contrary.

                Ask him to open a normal rupee account which is not NRO either in his name or any other name. Add a line in the agreement that money will be transferred to X account in Y bank. Make sure that all addresses and contact details are Indian. Then you can claim that you don’t know that you’ve rented from an NRI.

                  “The TDS deducted from the rent paid must be paid by the seventh of the following calendar month.

                  If the tenant does not pay the TDS on time, it attracts prosecution under Section 276B of the Income Tax Act, 1961. That is, it may lead to imprisonment ranging from three months up to seven years.

                  When a tenant fails to deduct tax from the rent paid to an NRI landlord, the tenant may also attract a penalty equal to the TDS amount as per Section 271C of the Income Tax Act.”

                      If you want a image to be submitted as evidence you need to prove that it’s genuine. So for that you would need to prove that Google took the images on that day, that Google’s image on any day reflects reality and the image in question was taken on that day.

                        The legal position is that if you are aware that a crime has been committed you are duty bound to inform the authorities. The act states this “Whoever, knowing or having reason to believe that an offence has been committed, intentionally omits to give any information respecting that offence which he is legally bound to give, shall be punished with imprisonment of either description for a term which may extend to six months, or with fine which may extend to five thousand rupees, or with both.”

                        So it’s clear that you need to report it.

                        But from a practical perspective who knows that you know ? The fact is that if you deny that such a conversation ever took place , who can prove otherwise ? Also it’s extremely unlikely for you to be convicted since at best you did not report a crime of not informing the authorities.

                          Asset seizure should have happened by now if it is to happen. When an accused dies during a trial or while an appeal is pending, the criminal proceedings against that deceased person are terminated as it is rendered infructuous.

                            Without the details of the case it’s hard to say but

                            Getting bail sometimes can take a lot of time. Courts grant custody routinely and until you secure bail you rot in prison.

                            That is not a legal question

                            Your dad can’t just escape prosecution just because he can pay an amount. There’s not much you can do

                            You will not be liable in any way, but if you own property jointly with him, it may be an issue but even that is a remote possibility.

                            If it’s going on for 20 years in the trial court , honestly it’s not going anywhere.

                            At this point that’s futile

                            Distressing though it may be, ignore the problem. In fact it’s now to your benefit to drag it on even longer since no decision means no conviction and no change in the status quo

                                  What is the meaning of this question and can it have an answer? We haven’t created an app yet called Bookmylawyer

                                  With any service, who is to decide the price ? Why is Nalini Chidambaram entitled to lakhs for an appearance vs say a lawyer outside the court charging 500 rs. ? Is the difference in advice worth the lakhs ? Maybe, maybe not. Or take say the case against Ajmal Kasab, could any lawyer have managed to prevent his death sentence ? If not, then why could he have not been represented by a person charging 500 rs. ? In terms of outcome it would be exactly the same.

                                  Like everything else in this world price is not a barometer of anything except expenditure
