      If the DSP stated he would file the chargesheet with the modesty charge included, I would say give him time.

      The sequence of events is: FIR then Chargesheet. The police takes 60-90 days for the IO (investigation officer) to complete his investigation of FIR and file chargesheet. In my experience it’s closer to 90 days but officially they get 60 days to file chargesheet.

        If you can show injury to you due to the lie perpetrated by the buyer, you can keep 5 lacs and sue him for more.

          Legally speaking, yes you have to return.

          But you could become corrupt like others in India who take token money and not return.

            What did the NCW say? If the police is refusing to file a particular charge for which you have proof, you should file a complaint against the police with the NHRC (National Human Rights Commission). Tell them you suspect police has taken bribes from the other party.

                          That’s untrue. A senior citizen who has a fake 498a complain against him/her, can be jailed. There are so many instances where 80 year old father’s have been jailed after a fake Domestic Violence under 498a was filed against them. The more backward the state you reside in, the worse treatment innocent people get afte fake FIRs.

                              How did he leave India after his overstay? Airport?

                              If you have overstayed your visit in India, you need an exit permit. To get the exit permit you have to pay a fine. If he has already left, I’m guessing he had to get an exit permit and has already paid fines.

                              That means he can come back to India for a visit without worry as a fine for his previous stay has presumably been paid when he exited the country last.

                                  Unless you have committed a provable crime, absolutely no one can compel you to come to India. In extradition cases, the Indian police and judiciary needs to prove in US courts that you committed a crime. Same in civil cases, harm needs to be proved in US courts.

                                  Filing a writ in high court is a waste of time and money. There are 50 million pending cases in high courts across india, no one has time for writs for someone who is not even present in the country.
