January 11, 2025 at 9:16 amYes nepotism is rampant in the judiciary. Recently SC has started a trial run of a new system where they will individually interview candidates which was not done before, and someone who’s parents or relatives are judges won’t be made judges. If the new system works then it will help with the nepotism issue.But that’s not just the only problem. How do you stop bribery? I believe bribery by politicians and rich people is a major source of their income.
Now coming to that 498a. It started happening 2014 onwards when SC relaxed the conditions in which the wife could file that case, made it easier for them to do so.
Lastly, if the lower court judges did their work properly the situation would greatly improve. Even cases where it is common sense to know what is happening, the judges will make some absurd, illogical judgement and the victim of judiciary will have to move higher up to appeal

January 11, 2025 at 2:39 amThere’s a concept in philosophy about explicit will and implicit will. I read about it years back. Explicit will is when you decide what you wanna do and don’t. But somethings like citizenship of a country is implicit. When you’re born here you have to follow the laws.Even if you’re a foreigner, when you’re in india you have to follow the law of the land. That’s why they call it “law of the land.”
