Be transparent about your situation and cold mail companies/ individuals seeking work. But don’t resort to illegal means and deceiving tactics.

Lawyer here based in Delhi. She could file cases here in India if the cause of action in part/wholly arose in the territory of India. It’s a separate thing that it could be cleverly manipulated in such scenarios involving disputes between NRI’s but that would require an in depth explanation of the situation.

Aise koi jail nahi jata unless you disclose a cognizable offence in your complaint. Because only then, the police has the power to arrest a person without a warrant.
              Bina affidavit ke dedo complaint.

Application nahi, ek complaint likh do saying that- you are under an apprehension that when you and your family will get separated from your father, then your father may do ____ & ____ things. Kyuki agar kal ko kuch hota hai to it will work as a trail/evidence for future. Remember to take out two copies of the complaint, ek original police station mein dedo aur copy pe receiving with date and stamp lelena.

You could get a well drafted legal notice sent to them before initiating any legal proceedings. Depending on their response, further things could be planned. Chances are that the legal notice would just be sufficient and even cost effective for you. Lawyer here based in Delhi.

Good luck explaining all of that to a judge. In all honesty, you don’t have a great shot at recovering that through any complaint or suit amount albeit you can try either by convincing her or being tough, anything which suits you. Hope you’re in a better position in future though, because that sounds like a top tier kalesh.

Yes you could do that but your lawyer would have to keep in mind, some mandatory compliances. Also, you should first exhaust the option of getting a meticulously drafted legal notice sent on your behalf to your ex employer. I’ve had 50% of such cases resolved just at that stage without proceeding into any further litigation. Lawyer here based in Delhi.

If you know who’s the person, things could end up pretty quickly and most likely that person would come up apologising at you. If it’s anonymous, it would require some additional effort. Lawyer here based in Delhi

Punishment would be mostly punitive if they decide to file a complaint. Having contested a lot of cases from complainant side as well as the accused’s side in similar matters, my only advice would be to make sure you engage an effective lawyer for negotiations because that one decision could make up a world of difference for you.
