January 28, 2025 at 3:07 amYou do understand that you can’t give or take loan in cash? Your story is not believable. Why could your aunt not do a bank transfer? Why she had to withdraw and give it to your father? And when he had to return the loan why did he not use banking channel? There is no way AO or even ITAT will believe this story. But if you do accept it as cash loan and settle the matter please check if new notices will be issued for cash loan. Never give any submission about it being a loan. A CA or lawyer can advise better but I don’t think you have a case. Better to pay the penalty and close the matter.FFierceanirudh9723

This is how third party damages work. Sue them and then claim. January 21, 2025 at 6:35 amRemember the golden rule of lending. Lend only what you can afford to loose unless it’s about helping a close family member in life/death matter. This doesn’t look like a life/death matter and it doesn’t look like your girlfriend can afford to loose the limited money she has.Also her lending the money won’t solve the problem of this family because the tuition costs are 1.5/2L per semester (~8L for 2 years) and all your girlfriend has is 1/10th that amount (80K). Where is the remaining 7.2L coming from? So the outcome doesn’t change whether your girlfriend helps them or not.
Better the son/daughter quit their studies for now and start some job. If the mother can take up job and support the family then nothing like it.

January 20, 2025 at 4:20 pmYou can find an advocate that you can afford. I have worked with lawyers that charge 2000 and also that charge 25000 an hour. In fact I once met a lawyer in his office who had a stop watch and charged Rs 1000/- for every 5 mins. You asked question and he would respond. A minute before 5 mins are up he would ask whether I wanted to extend for another 5 mins.This is true for doctors, engineers most other professions as well. You will find them offering services at different price points.
So long as the lawyer informed you about his fee upfront I don’t see how you can pass a judgment how much he/she should really charge.
Also it doesn’t matter about the value of the property or dispute matter. You are paying for the lawyer’s time.
