A lawyer here who has handled good amount of divorce and DV cases

Even if you have all these conversations and set boundaries and everything. Both the persons are going to change so what matters most is mutual respect and understanding. I have handled love marriages of 10 yrs turning into divorce with zero trust. 20 years of marriages into divorces just because there are family differences. 3 months marriage because the husband was into alleged extra marital affair.

Honestly speaking nowadays no wants to adjust and there is no will to mend the relationship and just get divorced.and the sad part is the kid suffers the most.

          I meant lumpsum only

Lumpsum amount of EMI and lumpsum amount for maintenance. Now as you said you have a decent income and if you can manage yourself and your son, you can reduce that amount a bit and get your EMI sorted out.

All these amounts are transferred before you give him the divorce so you don’t need to worry about whether he will pay or not..

            A lawyer here.

Reading your post I feel that you are going for a mutual consent divorce.

So in this you can always come up with a consent terms mentioning whatever you seek from him. The upfront payment of EMI – Maintenance for yourself and Son and even custody or visitation rights for your son.

Sit down and pen down how much amount you will need and ask for upfront payment of EMI. There is always a safety clause where you can invoke proceedings against him if he defaults in it. As you said he already has found someone so he is not likely to default as it will add to his mental stress

Get the consent terms signed with him involving all these amounts.

                Lawyer here

So your employer has filed a summary suit against you where you need to tender your appearance within 10 days of receiving the summons.

Anyway you need to hire a lawyer from Ahmedabad and file your vakalatnama and also show that you have a strong case on merits.

Summary suits are an accelerated procedure where unless you can show you have a strong defence, the court will go ahead without hearing you.

Please consult a lawyer and also try if you can settle the issue with the company given you have all proofs.

                  Autocorrect sorry…

Yes the well being and maintenance is duty of the society . But if the object was thrown by some member then society won’t be responsible.

Now if some part of building broke and fell off then the society will be liable or you can ask society to investigate upon this and check all CCtv and see who threw the object

                    Lawyer here

I don’t think you can recover damages from the society. As you mentioned that something dropped on your windshield, there is good chance someone threw it from.upper floor.

For society to be responsible you need to makeout negligence on their part. How can you straight away make them to pay for trophies?

That’s good.Keep in touch with the Investigating officer and get regular updates. Hope that your money is traced and blocked.

Post that you need to file for return of property and get a court order to transfer the same to other bank account.

                      Where are you from?

Lodge a FIR as soon as possible so police can trace the chain of accounts it’s transferred further and block some money out of the proceeds.

People having no knowledge of law and comment with such confidence.

Anticipatory bail is to protect you from arrest. The case can be maliciously filed too. Granting of anticipatory bail doesn’t mean one has committed the offence

If you don’t know.law then you should not speak up on social platforms

Please talk to your dad first. Show him the chats and everything and tell him what is happening. Ask him to talk to the guy’s mother. If nothing happens please go and file a police complaint with your dad.

How the hell you think beating up a guy is the solution for this? You have your entire life ahead. Don’t do such stupid moves.

Please consult your dad and take appropriate steps

There is a high chance police can find out the money trail. But that money will be blocked and you need to go to court and get the money back.

You need to mention whatever is the current situation. Why can’t you mention demolition?
