      Going to a temple and making our and smoking is literally an invitation for the locals to do something.

      Half our population is unemployed and single.

        If you are fired, have been declared as Absconding then your HR with label your file accordingly.

        If they file a case against you then this will show on background verification done on your name.

        Companies don’t always spend alot on BGV so one could get lucky also.

          Nothing you do will make it easy for your parents.

          Your loss might trigger them to do the same act..

          Everything in life can be figured out.

          Love, sex, money, respect any thing and everything could be earned back.

          My cousin committed suicide..it’s been over 20 years.

          Family cannot move on from such events..

          It shakes them and breaks them..

              Ask them for a copy of the policy.

              That document will have a date which specifies when it was revised.

              If the effective date of the revised policy is post your termination you could challenge their decision.

              Wording of the policy also matters.

              So read that and ascertain the Effective Date of the revised policy.

                Check your employment contract and the company policy on Notice Period and Variable Pay.

                Your employment contract would give the right to the company to change the policy as they deem fit.

                But this needs to be communicated to the employee.

                Also, usually Variable Pay is not given to those who on the date of disbursement (date when bonus and appraisal are paid) are serving their notice. Shady but quite widespread practice.

                If the HR cities company policy ask them for a copy of it and if it has been revised check it’s effective date.

                You certainly can litigate this but conduct a cost benefit analysis before taking any action.

                  Massive red flag.

                  If you leave within a year the following is usually expected to be paid back

                  1. Joining bonus
                  2. Relocation allowance
                  3. Cost of the stay and food company incurred if they provide you with accommodation

                  No one asks for salary to be repaid.

                  In some cases, you are deemed ineligible for variable pay that might have accrued but no1 absolutely no1 asks for the entire salary to be repaid.

                  Take it as a red flag and run.

                    Hey buddy. In house counsel here.

                    You will need to read your employment agreement and the company policies on notice.

                    You need to ensure your resignation notice needs to be given in writing.

                    You can clearly state what your last working day would be like and could request for an early release which it looks like the org won’t accept.

                    So you may need to serve the full notice period.

                    Start creating a trail where you ask your manager to whom you need to handover your work. Keep them updated of the progress.

                    Offer to find a replacement.

                    Keep important stakeholders marked in all emails also keep your personal email in BCC.

                    Make a copy of all important emails (not including company data), download your payslip, forward yourself the resignation email.

                        It’s a case of defamation by libel.

                        But guess she is just hurt and healing.

                        A legal case might not be the best way forward.

                        Be kind. For your mother’s sake.

                        Win her with love if possible. Reply on her comment saying what you intend to do with the proceeds.

                          First thing first read the employment contract well.

                          Check in the termination clause if the employee has the right to buy out the notice period or not.

                          If he does, then he needs not serve full 60 days.

                          Also, notice period begins from the day it was communicated not the day it was accepted.

                          If the employee does not have the right to buy out his notice period he may have to serve the full period. If he doesn’t the employer will mark him as absconding and it may show in his future background verification.

                          You must ensure that you return all company property and get an acknowledgement of it.

                          Your “friend” should spread so much toxicity at work that is he asked to leave soon.

                            You get special protection if you are an MSME.

                            Send a legal notice through a lawyer.. wouldn’t cost much.

                              You need to resign.

                              You have committed a fraud and you will likely be terminated and this will show on all your background search.

                              Resign and offer to pay money in lieu of notice period.

                              They can deduct the amount you have defrauded them for.

                              Also, world is not stupid.

                                You seem to have a strong case.

                                Don’t worry about the defamation case it won’t stand.

                                Maternity benefit Act provides you with reasonable protection.

                                You simply need to lawyer up.

                                Find someone who is passionate about women empowerment or reach out to a NGO.

                                Check if your organization has any political affiliation if yes go to the rival party and ask them for help.

                                And lastly do not forget to Name and Shame them..

                                There can be no defamation case against you if you are simply narrating the facts.
