        You can lend money as a friendly loan but can’t claim interest. If The court deems fit, can allow it as damages that too nominal savings bank rate interest. Owing to the fact that if this money was kept in saving banks account for over a certain period of time would have fetched a particular amount of money.

          To get an answer to this simply google bollywood movies, series, songs, shows with vulgar meanings and abuses and you’ll get your answer. Censor boards have been allowing them for ages.

              The continuous cause of action can be used as technical ground to make it within 3 year limitation and if the cheque was issued with a date of 3 years back. Then 138 won’t sustain.

                    If you have cheques you can file a 138 NI act case. But if the cheques are dated 3 years back then you won’t be able to file it as the cheque is valid for 6 months from the date of issuance.
                    Also intimate him before submitting the cheque in the bank.

                    Also you can file a suit for recovery showing continuous cause of action as time period is 3 years.

                    If he threatens to file bankruptcy ask him to go ahead and as soon as he does. File your statement of claim and then as the RP will be appointed, he will analyse the claims and then accordingly the tribunal will pass orders.

                    Also file police complaints for fraud and cheating to create some pressure.

                    As he paid only for two months in three years his intention to defraud can be easily established.

                      As there is no will, it will be intestate and all the assets will be equally divided among all legal heirs.

                      Get a legal heir certificate, then get a succession certificate and if your brother doesn’t agree to divide equally, you’ll have to file suit for partition as per the succession act.

                      Also, if the FD’s are in your dad’s name and you are the nominee then as per banking rules the nominee gets all the amount, so without much hassle you can claim.

                      Don’t sign anything without consulting a lawyer.

                          If you wish to seek mutual divorce you should discuss it with him and in two motions it can be wrapped up.

                          6 months cooling off period between both motions can be waived by way of application.

                          If he disagrees then a contested divorce is the only way out.

                              Pay the loan and get the land transferred in your name. Simply buy the land from your father. You’ll have an asset and your father’s loan is also paid. It becomes a win win for all.

                                  Install CCTV cameras.

                                  Next time they come dial 112 and call for assistance and get it recorded in official records.
                                  Also male police officers cannot touch females or even question a female without the presence of a female police officer.

                                  They can’t question women after sunset.

                                  They have to give a notice and call the women to the police station even after FIR is lodged.

                                  Coming directly to your house was illegal.
                                  If you go on to file a complaint the police officer will be in deep trouble.
                                  Also get a medical prescription prepared of the injuries you got.
