But you must understand that property may be self -acquired or inherited through succession. Depending on this, and the tenure of the land (whether it is divisible or not) would require a deeper analysis.

Limitation is generally 3 years from the date on which the party refuses to return the money, but there are a lot of technicalities involved.
Would recommend you contact a good civil lawyer in your area and proceed systematically.CCleversajal8453

March 6, 2025 at 5:32 pmIn case of a bank transfer, you would have ample proof so recovery should not be much of a problem, however considering the time period I would advise you to move early as limitation (time in which you must demand the money back) may become a problem.
Send them a legal notice, and if they fail to give you the money or deny the debt then you should be able to file a summary suit for recovery of the debt, you would also be entitled to interest from the date of filing of the case.
Unfortunately, you can’t get interest for the time period before filing of the case, as generally only banks, NBFCs and licenced money lenders can charge interest.
As for the question of the land, unless this was a written agreement it will be very difficult to prove, so would not recommend filing a case for it.

March 6, 2025 at 7:20 amIf you are in a Cooperative Society, then raise a complaint at the next meeting – if not addressed you can approach the Registrar/Board of Nominees per your state cooperative societies Act.
As for police inaction, keep copies of your complaints and then write to the SP stating that no action is being taken. If SP does not take action, you can file a complaint before the local criminal court.
Also, just as a warning you can check if your neighbour has made any illegal constructions on their property (sheds etc.) and apply to the municipal authorities to remove the same.CCleversajal8453

March 6, 2025 at 6:07 amFor the consequences part, in the end Property Tax can be recovered as arrears of land revenue i.e. they seize and auction the property to recover tax.
But with so many residents involved and the politics that follows, I don’t see anything like that happening.

March 6, 2025 at 6:01 amThere are special agencies that do this kind of work, raise disputes with the relevant parties (often these debts are sold to third parties, who sell it off further) and tackle it to get your CIBIL score up. -
