Courts have time and again held that an able bodied and educated woman cannot just feed off the funds of the husband and then claim exorbitant amounts, in the name of maintenance. But it has also been held that when even if the wife is working/educated and not working, she will still be granted maintenance, especially in cases where the wife could not work due to circumstances beyond her control.DDesiknight9081

And every little evidence adds up to evince the grounds on the basis of being divorce is being sought. So while what you have may be alright if there is nothing else, see if you can get more evidence, to strengthen your case.DDesiknight9081

She can file a Sec 498A complaint in the police station, which can encapsulate all his acts of cruelty, wherein she will also request for registration of FIR against him. Apart from that, she can file a Domestic violence petition and a contested Divorce petition (if she’s willing to stay away from him for a year before that). April 6, 2025 at 8:15 pmHi. I’m a lawyer here. Write them a very stringent email, as good as a legal notice, but not a legal notice, as for that you would require an Advocate. State facts qua your communication with them and tell them that you’re contemplating legal action, if the needful is done at the earliest. If that doesn’t work out, then consider sending a notice and you can consider filing a complaint in the worst case scenario. -
