April 6, 2025 at 1:15 pmHi. I’m a Delhi based lawyer. It’s not the case that consumer courts are bad. But since every legal proceeding follows a certain process, adjudication takes some time. Between filing of complaint, written statement, rejoinder, evidence of both parties, written arguments and oral arguments, you can expect about 10-12 hearings to take place. Try sending a legal notice before that, for it might help.April 6, 2025 at 12:46 pm in reply to: Need legal advice – Flipkart refuses return for torn & mismatched dress (Flipkart Minutes delivery) #20105DDesiknight9081

April 6, 2025 at 12:46 pmPlease check if the ‘No return’ condition was mentioned online, for your product. Contemplate steps accordingly. But either way, no consumer court will support Flipkart for selling torn items and not accepting it back due to their silly condition. Unfair trade practice is not entertained in any court of law. The process is to file a consumer complaint for deficiency in service and unfair trade practice before the District forum within your jurisdiction, either yourself or through a lawyer. It takes about two years for the complaint to be adjudicated upon. You can also send Flipkart a legal notice before that, and see if that helps your cause.DDesiknight9081

April 6, 2025 at 12:08 pmHe’s putting too much at stake, for a headphone. Because once FIR is registered, settlement won’t quash it, even if he returns it. He’ll have to get it done through a quashing petition in the High Court.April 6, 2025 at 4:44 am in reply to: Is it possible for husband to get a divorce without paying alimony if wife is involved in extra-marital affair? #20257DDesiknight9081

April 5, 2025 at 7:06 pmGo file a complaint on the cyber portal or else at the nearest cyber police station. And don’t answer unknown numbers, and if you’re very keen, first check the identity on True caller.April 5, 2025 at 7:02 pm in reply to: Legal options against an ex-colleague who borrowed money and ghosted me? #21817DDesiknight9081

April 5, 2025 at 7:02 pmOfcourse, it is valid. You’ve loaned out money to someone who has failed to return it, and it’s a legally enforceable debt, so you can go ahead with issuing a legal notice. But this does not fall under the definition of a cyber crime. I’m a lawyer myself, so if you need any assistance, please feel free to reach out.April 5, 2025 at 6:45 pm in reply to: Is it legal for an organization to send me a back-dated employment letter? #20338DDesiknight9081

April 5, 2025 at 9:31 amThe facts in each case differ, as does the financial status of both parties. Permanent maintenance and alimony are mostly words used interchangeably, but in terms of what you’re trying to ask- the answer is no. If 25% is granted, that will be the permanent maintenance/alimony awarded to the party, however there might be an arrangement wherein the party agrees to give/accept a certain amount as lumpsum and the rest periodically, but for all practical purposes, both terms mean the same, between spouses. About the quantum of maintenance, the percentage might exceed 25%, depending on the expenses required to be borne for the child.April 5, 2025 at 9:19 am in reply to: do witness need to come to court or they can tell on video call in high court ? #20827DDesiknight9081

April 5, 2025 at 9:19 amIn normal circumstances, witness has to be present before court to depose. Because they also need to mark their signatures on their cross examination. Cross is not permitted on VC. However, in cases where the witness is ailing/bed ridden, the concerned party can file an application for appointment of Local commissioner for recording of evidence, who can conduct the evidence at the residence of the witness, by following due procedure. -
