Before I answer this: Have you had a personal experience AFTER withdrawal of complaint before PAC?

There are no checks on this protocol because they are literally playing by the book. What all I mentioned, are indeed offences as per law. However, these are far less important offences to be arrested. It is the Parliament that befools us all! Parliament is sitting with eyes closed and mouth shut, and not acknowledging changed circumstances of the modern day.

Regarding non disclosure of name: Yes, absolutely true. Please read Section 39 BNSS, 2023. Identical section was present in now-scrapped Cr.P.C., 1973.

ADVOCATE HERE. I’ll tell you more: State polices file FIR for: A. Against parking managers for not checking the underbody of a vehicle before allowing its entry. B. For carrying a scissors beyond regular length in public. C. For being top seller of food on your street i.e. being crowded. D. For not revealing your name. E. For putting up a banner on a public wall! I CAN GO ON. THESE PEOPLE LITERALLY ARREST PEOPLE ON SUCH ALLEGATIONS. I GET THEM BAIL ON DAILY BASIS! This is how absurd sometimes police gets.

That’s incorrect. Every State Police has internal directives/SOPs for concluding investigation. It can range anywhere between 30 days to 90 days. What is crucial in YOUR PARTICULAR SCENARIO, is that medical examination should have been done on the very day, which I believe was not done. In this light, you may approach Court to monitor investigation.

ADVOCATE HERE. I will take the liberty to presume that you actually lodged the FIR, not merely a complaint to police, these are two different things. Now, since FIR is lodged, you don’t really have anything in your hands, except to seek police protection. You cannot control investigation unless you see deliberate and manifest faults, which is when you will have to approach area Magistrate’s Court. Things are really simple there, though appear nerve-wracking to citizens. Don’t worry. My best wishes.

Can she file? Yes. Whether she’ll win? No, but you will have to prove that she is in capacity to maintain herself, which requires handful number of hearings.

ADVOCATE HERE. This was an act of embezzlement of funds. Showrooms are on franchise models, and they pay certain amounts on every sale to RE’s parent company. I would suggest that you write another email/complaint and stick with your cash reimbursement that choosing any product, because what you get from showroom, you get the same accessory at 1/3rd outside the showroom. My best wishes.

ADVOCATE HERE. To exit from a company, labour law isn’t material, contractual obligations i.e. norms of your appointment are. However, if you are harassed at your workplace, of course labour law comes to rescue. Given that it is Bangalore, I’m given to believe that you will require everything in formal through proper channel, else, they will merely delay/put you in difficulty. My best wishes.

ADVOCATE HERE. Well, an adult need not necessarily be in contact with parents. However, your mother can certainly file a case for maintenance against you. You still don’t need to remain in contact for case purposes, as long as you keep paying and maintaining her. This was something ahead of you, however, to address your immediate concern: You are under no obligation today to remain in contact with her. WHAT YOU CAN DO: File an injunction suit seeking stay order against her, so that she doesn’t contact anymore. This is bound to get you results. My best wishes.

ADVOCATE HERE. I’m given to presume the product you ordered is of value less than 10K. In such a case, not exactly viable for you to file a case or get a legal notice issued. In this light, alternative propositions are that:
                        A. You lodge a complaint over NCH, or
                        B. You write an email in legal language (get it checked by a brother-like advocate) stating that if not replaced/returned (whatever you want), then legal remedies will be invoked.
                        C. Approach locally established mediation bodies.

And before you ask, YES, since your invoice mentions so, that will be used to your advantage, and not the main TnC policy. This is something we do for contracts on daily basis. My best wishes.

However, if the person remains missing and beyond reach of family for 7 years, he will be declared dead by concerned Court upon pleadings, and once declared dead, his legal heirs will be made liable for payment.

ADVOCATE HERE. Often done to meet targets. Just write to concerned branch as well as head office, along with a complaint to cyber/local police station about misuse of identity and cheating. You’ll be good to go. My best wishes.

One hack would be, to determine if you are eligible or not (on basis of personal information like gender, income, caste etc.), you may approach local DLSA for a government sponsored advocate. However, their promptness in drafting, filing, appearing before Courts etc is something specific to the person so appointed for you.

ADVOCATE HERE. Firstly, glad that you stepped up and helped a third party. Secondly, you have no reasons to be scared for the next time because ON THEIR FACE you can refuse to “take care until a family member arrives”. This is standard tactic on police’s end to avoid the said duty on their part. You can even refuse to get your statement recorded, though they are in their place to gain hold of your name and address.

You have been a hero once, be a hero and continue to inspire others too. Good people are harassed often, don’t get discouraged, rather, call your own hero (advocate). My best wishes.
