      Indian law favors women. There are a million avenues in India if a woman wants a divorce. Husband can contest, but you’ll be given the preference.

        If the marriage has not been consummated, you can file for annulment. This must be done within the year.

        Option 2: you have to stay apart for a year, and file for mutual divorce. This is the easiest and quickest.

        Option 3: Show cruelty or other reasons for divorce and file contested divorce.

          If it is genital herpes, venereal disease counts. Especially if your brother does not have it. It could also be used as mental cruelty (I.e. wife asking for sex during an outbreak- HSV has no cure).

          Separation counts if your brother moves back to parent’s house. Just have CC installed to counter any claims she may make.

          You cannot do anything about your SIL’s brother.

            Here are your options:
            1. file for divorce based on the evidence you have. At that point, the DV and all other cases will be closed (you still need to file for quashing of she filed 498).

            2. Reconcile and stay in a dead marriage knowing your spouse may cheat again.

            I’d question the legitimacy of the children. I know it’s tough to hear, but recently there are cases where the court has accepted the testing.

            As for alimony- if she has a job, she will not be given much. You will be asked to pay child support. Custody wise, unless the mom is mentally unfit, she will be awarded custody. There’s not much you can do to protect your children. Now, if your children tell the judge they want to stay with you, you maybe able to keep custody.

                If she has worked in the past, and you have proof, there’s plenty of case law that shows no maintenance has to be paid. You may need to change lawyers.

                  What is your lawyer advising you?

                  You can claim her prior work experience and working ability to show that she can work. There’s plenty of cases out there where a working woman was denied maintenance. Use that.

                    Indian women are given a gun in form of a law that was passed by Congress in 1980’s. It’s because of this law that divorce rates have gone up- women want to be terrorists instead of being wives who will work on marriage. In 50 years from now, we can finally realize that marriage as an institution has failed and families have been torn apart by this law.

                      I am in this situation currently. Fighting false 498a, dv/maintenance. She involved everyone in the family (because they came to wedding). Initially I was sad and upset. And very stressed. I’m greyed a lot and put on a lot of weight. I started working out and involving in activities to take my mind off it. It works a little, but the issue is still in your conscious. I’ve come to accept that Indian law is lawda for men. I’ve also accepted that I have to pay her something. Since I have nothing going for me, I will pay her- after her child bearing years are done. I will marry again and have kids. If she wants to settle sooner, she will settle for my terms. Once you understand this- I think you will understand that you will be a winner in life. And I’m happy with that.

                          TSA is doing his job. You need to know rules of travel before going to airport. What you gonna complain about next? “TSA agent didn’t let me to the terminal because I had no visa?”

                              It’s not just the men. What I learned is regardless of how much scrutiny you do on your partner, if she decides to mess your life up, Indian law makes it happen. ONLY in India is a husband declared as a criminal even without evidence.

                              And the pressure is not on the husband alone- it’s his entire family. If the family has daughters, then their marriages are at stake too. It’s such a sad sad society we live in.

                                Whether it’s headache or not, if you saw it and can recognize the person, you should help the innocent party out.

                                If no one comes forward, why do we need to exist as a civilization or society.

                                  Indian law gives women a gun and knife to a man, and watch them fight. Nothing more bs than this.
