UHow can they even keep phones for so long?Are phones not allowed in the school? If not allowed then why do students carry them?
UUnfortunately when you join a social media platform you agree to it’s rules. One of those rules of reddit (which i also got to know by an experience like this) is that if you’re banned from a sub reddit you are not supposed to bypass that ban in any way. If you do, your account will be suspended by reddit.If i understand correctly the same has been done to you. And in cases like these, reddit won’t listen to your appels. Only the mods can reach out to reddit.
UYes social media chats are used as evidence. And if you have the original chats, the audio message will also be part of the conversation and should be accepted.Because the audio is being sent by the person himself. Not by you. So there’s no point of calling them fake. If you do that you’re just throwing logic out of the window and might as well say no one is real both the people in the chat was the judge goofing around with the two phones.
UThen your best bet would be to negotiate a settlement with him wherein you two will file for mutual divorce if he pays back the money and he can have the custody of the children and you get visiting rights (or joint custody whatever is your preference) and you forego any alimony or maintenance requirements. If he does not agree you go for contested route and they’ll not only lose years in the proceedings, they will lose the money, the children and may even face repercussions of taking dowry.I’m not a lawyer so do consult your lawyer about this.
UUsually courts grant custody to the mother and then order the father to pay child maintenance. Especially if the children are young (like you said you spent 7 years on their care so i assume they are around 10 at most)Depending what kind of person you are morally, your lawyer may convince you to file false cases. Please don’t do that. Laws and courts are already wife favoring in matrimonial cases, you don’t need to make someone’s life worse than is necessary.
UThe police may call you to help in investigation at that time show all your statements to show the money was transferred to the uncle and you have no association to it. Get a lawyer to put your story and get the fir quashed.Regardless of your role an FIR can mess up your life. Furthermore sue the inlaws for damages if they are falsely accusing you too.
UGood point but i don’t think they can make OP here pay anything, X money came from the inlaws and X money went to the uncle.If they can’t show any other transaction they can’t demand any money but yes no one knows if the police may endup freezing the account or something so better safe than sorry.
UDid she or her family ever transfer any money to you? If yes then they can say that is the dowry money. If she cannot prove then the problem is a little bit less.For harassment case, there have been several judgements where the fir had been quashed by the court due to vague allegations, not citing specific incidents, there date and place. Etc. Lack of details about harassment and absence of family members from the household (like she said some relative who doesn’t even live with you is also involved in harassment) can easily lead to her discredit and fir getting quashed.
The next thing is, she can come barging into your house (which is her matrimonial home) along with women organization, police etc and get entry. If she gets entry then she can get you all evicted by saying you all are still harassing her. So if she has left the house do not let her enter. Use all the females in your household to stop her by force, keep the males away from that matter if and when she decides to come back.
When you are able to get false cases quashed, you can file defamation case, perjury case against her and her family.
Don’t just go ahead and apply for divorce because she will then get interim maintenance and money to fund her legal battle. Consult a good lawyer.
