I am a lawyer too and this is genuinely the best advise that you need. Don’t waste your time and energy for this battle. It’s really not worth it.

I’m sorry but what you should be more concerned about is what a horrible thing it is to do. Put yourself in her shoes for once. You’d rather live separately and try maintaining a balance both ways rather than rendering her homeless in a city where she wishes to live. About the legal bit, she can file whatever she wishes to, but I think morality is a bigger concern here.

She will only be called to court if your uncle adds her name to his list of witnesses to prove the facts of the case. She can also choose not to file her evidence. Either he can be told upfront not to add her or she can choose to not appear when it’s her turn and let her right be closed. Either way she can evade appearance. Don’t think there’s any cause of worry yet. Thanks.

Okay are you sure? Because your post suggests otherwise. However, if shes not been made a witness to the proceedings yet, it’s fine. Just tell her to stay put and not sign any other document.

Hi. I’m a Delhi based lawyer. What has she signed? Has she signed the evidence by way of affidavit to be filed on her behalf? Or her name has only been included in the list of witnesses yet? Even if she’s signed the former, tell her not to show up when it’s time for her cross examination and gradually her right to be cross examined will stand closed.

Hi. I’m a Delhi based lawyer. Would normally advise one to finish at pre litigation level in so far as small consumer disputes are concerned, but this seems like grave deficiency in service. You must go ahead and file a consumer complaint, impleading them all as parties. Seek refund and heavy compensation for the agony caused.

Hi. I’m a lawyer here. Your lawyer has no business not to share with you that remotely relates to you, document or information . Visit him personally and ensure that you have it all. If something doesn’t turn out to be right, please let go of him and consult another lawyer. Not saying you shouldn’t take action against him.

Hi. I’m a Delhi based lawyer, and I do know a couple of good lawyers in Mumbai. Not sure what’s the fee structure you’re looking at for quashing but generally no one does it at a super minimal fee. Drafting it is hard work and it involves research, arguments etc, which is again a lot of work. So even the most reasonable lawyer will charge a bit.
